Liability shift 1st January 2005
Prior to 1 January 2005, with face-to-face transactions, any losses caused by card fraud (e.g use of counterfeit cards, cards which are lost or stolen or those which were not received when posted to the cardholder) were usually borne by card issuers.
Since 1 January 2005, liability for such fraudulent transactions undertaken with a chip and PIN card will be borne by the merchant if they have not implemented chip and PIN technology.
Merchants should continue to accept non-chip and PIN cards in the normal way as the fraud liability for these cards will rest with the card issuer provided the merchant carries out the usual checks.
What will this mean for you?
Although you may not have experienced losses through fraud in the past, this will change if you have not updated your equipment.
- If you haven't upgraded your point of sale equipment to chip and PIN, you will be liable for losses from fraudulent transactions
- It's likely that fraudsters will target merchants who have not adopted chip and PIN technology further increasing your risk under the liability shift.
If you own your equipment...

If you rent your terminal from us...
We are in the process of upgrading these terminals. If yours is yet to be replaced we will be in contact with you shortly to arrange this.
If you use a combination of your own point of sale equipment and terminals rented from us, we will upgrade the terminals you rent from us, but you are responsible for upgrading the point of sale equipment that you own.
